Please read these terms and conditions carefully before communicating with our company.  By submitting forms, sending emails, or engaging in phone conversations, you acknowledge and agree to the following terms:

  1. Communication Purpose: All communication with KDX Forensic Consulting, including form submissions, emails, and phone conversations, is intended for informational purposes only. It does not create a formal business relationship, contract, or any other legal obligation between KDX Forensic Consulting and the communicating party.
  2. No Initiation of Conflict of Interest: Communication with KDX Forensic Consulting does not create a conflict of interest that would prevent us from working for other clients. We retain the right to engage in business activities with other clients, competitors, or entities, without any obligation or duty owed to the communicating party. KDX Forensic Consulting and Kevin P. Kulbacki will not be considered as engaged and may not be listed as a witness or otherwise noted as engaged to other parties or be bound by conflict-of-interest obligations until a Client (i) returns signed copy of KDX Forensic Consulting’s current Retainer Agreement, (ii) KDX Forensic Consulting accepts the engagement, and (iii) the initial non-refundable Engagement Fee has been paid in full.
  3. Retainer Agreement: In the event that you wish to engage KDX Forensic Consulting’s services beyond informational communication, a separate retainer agreement must be completed. The retainer agreement will outline the terms, scope, and obligations of both parties in the specific engagement.  A copy of our retainer agreement is available upon request.
  4. Conflict of Interest Check: Upon submission of a retainer agreement, KDX Forensic Consulting will conduct a thorough conflict of interest check based on the information provided. Please be prepared to provide the names of all parties, lawyers, and law firms involved to be cross-checked against our records to ensure that there is no conflict of interest in this specific case that could affect our ability to work with any of the parties involved. Upon retention, KDX Forensic Consulting will be available to handle the matter and prevented from providing professional services for any other party in this specific matter, unless an agreement is made by parties to jointly secure KDX Forensic Consulting’s services and both parties execute a conflict-of-interest waiver addendum.  Engagement of KDX Forensic Consulting does not prevent KDX Forensic Consulting from accepting or continuing work on unrelated matters for entities involved with the matter.
  5. Confidentiality and Non-Disclosure: KDX Forensic Consulting will treat all information submitted with confidentiality, as described in Rule 1.6 of the ABA Model Rules of Professional Conduct.
  6. Limited Liability: KDX Forensic Consulting shall not be held liable for any damages or losses arising from the use or reliance on information provided through form submissions, emails, phone conversations.  While we strive to provide accurate information, we do not warrant the accuracy, completeness, or timeliness of any information shared through these channels prior to being formally retained.
  7. Modifications and Terminations: KDX Forensic Consulting reserves the right to modify or terminate these terms and conditions at any time, without prior notice. Any changes will be effective immediately upon posting the updated terms on our website.
